Checked October 20, 2026 against the permit text published by South Dakota Department of Agriculture and Natural Resources. Sources and sections are listed at the end of this page.
In South Dakota, construction stormwater coverage comes from General Permit for Storm Water Discharges Associated with Construction Activities (permit no. SDR100000), issued by South Dakota Department of Agriculture and Natural Resources (DANR). It took effect November 1, 2023 and expires October 31, 2028.
Where we can help. Sites outside a qualified local program. Inside one (for example a city program approved by DANR), you follow that program's rules and we check fit before you order (Section 6.1).
At a glance
| Item | What the permit says |
|---|---|
| How coverage is obtained | NOI (Appendix A), signed by the project owner, at least 15 calendar days before construction; Contractor Authorization Form once a contractor is known (Section 2.4) |
| Agency fee | Not stated in the sources we checked. |
| Who may prepare the plan | No licence, seal or certification named for the SWPPP (Section 5) |
| Who inspects | Your staff or a third party, knowledgeable in erosion and sediment control (Section 4.1) |
| Inspection frequency | Every 7 calendar days, or every 14 days and within 24 hours of more than 0.25 in or snowmelt runoff, with an on-site rain gauge (Section 4.2) |
| State forms and templates | No mandatory state SWPPP template named in the permit |
Points that are easy to miss
- Inside a qualified local program, the local program's requirements apply and a violation of them is a permit violation (Section 6.1).
- The NOI is due at least 15 days before construction (Section 2.4).
- Choosing the 14-day schedule requires a rain gauge on site (Section 4.2).
What a SWPPP Desk plan covers here
We prepare a site-specific plan written to SDR100000, with each section mapped to the permit part it answers. You, the operator, review and sign it and keep it on site.
Checkout open in South Dakota. State ruling: Sell (screen qualified local programs). The site check on the plan page applies these conditions before payment. See coverage.
Before checkout you confirm:
- If the site is inside a qualified local program, you will tell us, and that program's requirements apply.
What we do not do
- Our plans are not sealed or stamped. BMPs that need design calculations, such as sediment basins and post-construction practices, come from your design professional.
- The operator signs the plan and is responsible for it.
- We do not visit or inspect sites.
- We do not file the NOI or any permit application for you. We tell you which form and portal the permit names.
